Why the Government Has Prohibited the Use of ‘Dark Patterns’ on E-Commerce Websites

In an effort to protect consumers, the government has prohibited the use of “dark patterns” on e-commerce platforms. These are tactics designed to deceive customers or manipulate their choices, and the Central Consumer Protection Authority (CCPA) in India has issued guidelines to prevent and regulate their use.

The use of dark patterns is considered a form of misleading advertisement, unfair trade practice, and a violation of consumer rights. Those found in violation will face penalties under the Consumer Protection Act. According to Consumer Affairs Secretary Rohit Kumar Singh, dark patterns are increasingly being used in digital commerce to manipulate consumer behavior.

The newly issued guidelines aim to bring clarity to all stakeholders, including buyers, sellers, marketplaces, and regulators, regarding what constitutes unfair trading practices. Dark patterns are defined as deceptive design practices that mislead or manipulate users into taking actions they did not intend to. For example, “basket sneaking” involves adding extra items to a user’s checkout without their consent, resulting in a higher total amount payable.

Another example is “forced action,” where users are compelled to take actions such as purchasing additional goods or sharing personal information in order to complete their intended purchase. The CCPA has identified 13 such dark patterns to guide the industry. Initially, 10 were identified, with three more added after public consultation.
